This privacy policy describes how we, Yorkshire Fertility and Menopause Solutions, collect and process Personal Information when providing our services. Personal Information is information that identifies you as an individual or relates to an identifiable individual. In providing our services, we may be required to process your Personal Information, and sometimes, that of your family members. We do this when you visit our website, use our services, (including our online booking engine), or deal with us by email or on the phone.

The Personal Information that we may process (obtain, use, store and transfer) may include the following:

Client data: for example, (but not restricted to) information on healthcare providers, professionals, staff belonging to the hospital, practice, clinic or other entity;

Client Identity data: for example, (but not restricted to) first and last name, username or similar identifier, marital status, title, date of birth and gender;

Client Contact information: for example, (but not restricted to) address, email address and telephone numbers.

Client healthcare information: depending on the information recorded by our Clients, this may include demographic information, medical records, prescriptions and test results.

Client Profile data: including your username and password and other information relating to your account with us;

Client Usage data: we automatically receive and record information when you visit our website, such as your IP address and information stored in cookies on your computer hard-drive. We process special categories of data (also known as "sensitive personal data") about Patients in the provision of our services.

We only process such data to provide our services and do so in accordance with data protection laws in the UK. Most commonly, we will use Personal Information in the following circumstances and rely on these lawful bases for processing your Personal Information:

- Legitimate interests: where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;

- Where we need to comply with a legal or regulatory obligation. Please note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we are using your data.

Data Retention and Storage

We will only retain Personal Information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. We hold personal data in electronic databases, such as our customer relationship management system. All payment details are stored with our payment provider PAYPAL. None of your payment details are stored by Yorkshire Fertility and Menopause Solutions.

We maintain an online platform to enable you, you, to access the following activities:

- electronically make an initial discussion and further appointments with the doctor

- communicate with the doctor and vice versa through a messaging system

- communicate with the doctor and vice versa through a voice and video conferencing system

- receipt and payment of invoices.

We are not a provider of medical or diagnostic services. Other than maintaining the online platform, we have no input, involvement, influence on interaction between you and the doctor.

Yorkshire Fertility and Menopause Solutions enters into a contract with the doctor which governs the appearance of the doctor with Yorkshire Fertility and Menopause Solutions and the charges made by Yorkshire Fertility and Menopause Solutions to the doctor for the Platform.

Your rights

Under certain circumstances, you have rights under data protection law, in relation to your personal data, including to: request access, correction, erasure, restriction of processing and data portability. Changes to this policy

We may review and amend this Policy from time to time. We will post updated versions of the Policy on our website.

Preliminaries

A time of day is a reference to UK time.

A working day is any day which is not a Saturday, a Sunday, a bank holiday or a public holiday in the UK.

The governing law is the law of England and Wales.

Your Account

We will endeavour to make our services available seven days a week. However, you acknowledge and agrees that our services may occasionally be unavailable during periods of planned or unscheduled maintenance or in order to put in place any changes, modifications or upgrades to our services outside of normal business hours, in each case where possible.

You further agree that to the extent that access to our services will not be affected or restricted, we may at any time perform such maintenance or put in place any changes, modifications or upgrades to our services.

Services

You may request a consultation appointment by e-mail and our acceptance of your order will take place when we send a message or call you with the appointment time, at which point a contract will come into existence between you and us for the provision of the consultation and associated services. When you request an appointment you may specify a preference for date and time. We will do our best to meet your preference, but if we are not able to do so we will contact you at the time of accepting your order to confirm if you wish to proceed.

Our services

• do not recommend or validate the use of any particular drug or a particular clinical diagnosis

• do not recommend any therapy

• are solely and exclusively a source of information for you

• are not capable of providing competent clinical judgement

• Under no circumstances be utilised by you to self-medicate without having previously consulted a medical professional.

Telephone & Video conferencing

Our services are for users in the United Kingdom only. This service is suitable for those aged 18 or over. Video consultations are only suitable for those who have an account and access to a webcam or mobile device with a camera.

Yorkshire Fertility and Menopause Solutions does not guarantee that a telephone or video consultation is the best course of accessing advice or indeed the appropriate course of treatment for your particular healthcare concern or medical issue.

Our doctor is not able to arrange referrals to the NHS as part of this service:

Prescriptions, sick notes and other certificates may only be available during office hours and are issued at our doctor’s discretion.

If you have a medical emergency you should not use this service and instead you should call 999 or visit your local Accident and Emergency Department.

If you feel suicidal, you should not use this service, but should make contact with your GP. You can also telephone the Samaritans on 116 123.

It is your responsibility to ensure this information is correct and complete and you accept that failure to do so (whether intentionally or not) will affect the information and advice we give to you and the medicines we may supply to you and, as such, may have consequences for which we are not responsible.

Our doctor may need to ask sensitive medical questions as part of your telephone or video consultation. Please ensure you are in a quiet, confidential place at your chosen time, free from interruptions.

Charges and payment

The charges are as specified on the website at the time you book an appointment. We use our best efforts to ensure that the charges are correct at the time when the relevant information was entered onto the system. None of the patients’ payment details are stored with Yorkshire Fertility and Menopause Solutions, they are only handled by our payment provider PAYPAL.

In the event that you fail to pay any fees due, we shall be entitled to suspend your account for a maximum period of 30 days before the account may be terminated by us. We are not responsible for any loss you may suffer as a result of such suspension or termination. If you have any questions about charges made to its account, you should contact us by email immediately. If there are charges made in error, we will credit your account or credit card account for the appropriate amount.

Cancellations, Late arrival and Missed appointment

You understand that if Yorkshire Fertility and Menopause Solutions needs to cancel your appointment, you will be contacted by e-mail in advance of your appointment. While every effort will be made to contact you at least 24 hours prior to your appointment, you understand that sometimes it may not be possible to notify you as early as 24 hours before your appointment. If Yorkshire Fertility Solutions cancels your appointment, you will not be charged for the cancelled appointment.

You understand that if you cancel your appointment less than 24 hours before your booked appointment, you forfeit the full cost of the appointment without any possibility of a refund.

Refund

You have the right to change your mind and cancel a consultation, but you need to give us at least 24 hours notice before your scheduled appointment. You will receive a full refund. If you try to cancel your appointment less than 24 hours before your appointment you will not be eligible for a refund.

If you decide to cancel the consultation after speaking with the doctor during the call and the doctor has confirmed they are able to carry out our services, you will not be eligible for a refund and the doctor will carry out the call.

A refund request must be made in writing via email to info@fertilityandmenopause.co.uk and is at the discretion of the doctor.

Privacy and Data Protection

The parties to this agreement will comply with all applicable requirements of data protection laws and General Data Protection Regulations. This paragraph is in addition to, and does not relieve, remove or replace, a party's obligations under the data protection legislation.

The parties acknowledge that, for the purposes of the data protection legislation, you are the controller and we are the processor (where "controller" and "processor" have the meanings as defined in the UK data protection legislation). Our privacy policy sets out the scope, nature and purpose of processing by we, the duration of the processing and the types of personal data (as defined in the data protection legislation, "Personal Information") and categories of data subject (as defined in the data protection legislation, "Data Subject").

You should read our privacy policy and upon accepting these Terms of Service, you shall be deemed to have accepted our privacy policy.

You will ensure that we have all necessary appropriate consents and notices in place to enable lawful transfer of the Personal Information to us for the duration and purposes of these Terms of Service and the provision of our services by us.

Communications

You acknowledge and agrees that we may at times send communications regarding your account or our services via email from info@fertilityandmenopause.co.uk. You can contact us at any time to opt out from such emails.

Technical Support

In the event of any technical problems with our services and/or website, you shall use all reasonable endeavours to investigate and diagnose the issue before contacting us. After making such investigations, to the extent that you still require technical assistance, you shall email our customer support team at info@fertilityandmenopause.co.uk. We shall respond to you within a reasonable amount of time.

Circumstances beyond our control

We will not be liable to you for any breach of or delay in the performance of our obligations under these Terms to the extent that the breach is directly or indirectly due to circumstances beyond our reasonable control. This shall include fire, flood, storm, other natural event, act of God, explosion, lock-out, strikes, civil disturbance or war.

We may end your rights to use the software and our services if you break these terms.

We may end your rights to use our services at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right, we will give you a reasonable opportunity to do so. If we end your rights to use our services, you must stop all activities authorised by these terms, including your use of the any services.
